2.7 Sale or Change of Status of Representatives

Policies

  1. A cannabis representative registration is not transferable.

  2. A proposed sale, assignment or transfer of a portion of a cannabis representative:

    1. that is a sole proprietorship, a partnership or a corporation, that is not a distributing corporation, as defined in the Business Corporations Act, and

    2. under which the activities authorized by a registration are carried out;

      Must be reported to AGLC and approved by AGLC prior to the effective date of the sale, assignment or transfer.  AGLC may approve the sale, assignment or transfer of a portion of the business and may impose conditions on the registration.

  3. A sale, assignment or transfer of 5% or more of a business: 

    1. that is a distributing corporation as defined in the Business Corporations Act; and

    2. under which the activities authorized by a registration are carried out;
      Must be reported to AGLC by the licensee within 10 business days after the effective date of the sale, assignment or transfer and must be approved by AGLC.

  4. AGLC may, in respect of a sale, assignment or transfer requiring its approval,
    1. approve it without conditions;
    2. approve it subject to conditions;
    3. approve it subject to the variation or rescission of existing conditions; or
    4. refuse to approve it.
